Official Rules for 2017 NetApp Innovation Awards

  1. SPONSOR
    NetApp, Inc., 495 E. Java Drive, Sunnyvale, California 94089, is the Sponsor of the Innovation Awards.

  2. ELIGIBILITY
    The NetApp® Innovation Awards are open to NetApp customers who have deployed, or are in the process of deploying NetApp products, solutions and/or technologies. Customers may be nominated for the Innovation Awards by NetApp employees, by themselves and/or by a third party. All entries must be submitted online at www.innovationawards.netapp.com. All Nominees must have expressed written or verbal consent to be submitted for the Innovation Awards. Nominees must use NetApp products in their IT infrastructure and/or environment on or before the Voting Period opens.

    At least one executive (VP or higher) representative and one additional representative must be able to attend NetApp Insight® in Las Vegas, Nevada on behalf of each respective Nominee. The Nominee’s representatives must be willing and authorized to participate in public-facing NetApp-sponsored marketing collateral showcasing the Nominee’s initiative when or if the Nominee is selected as a Finalist. Marketing collateral includes, but is not limited to, press releases, executive abstracts, videos, and infographics showcasing the project for which the Finalist is being honored. Finalists must also consent to the use of Finalists’ respective company names and logos in marketing collateral. Marketing collateral will be promoted through NetApp social media channels and NetApp web properties. Finalists shall have an opportunity to review and approve marketing collateral prior to publication. Nominees that participate in the Innovation Awards certify that their participation and receipt of the Prizes do not violate any of their respective company policies.

    The Innovation Awards are not open to employees, directors, officers, representatives or agents of NetApp and its related affiliates and subsidiaries. Officials or employees of U.S. state and local governments may be eligible to participate on a limited basis. If you are a U.S. state and local government employee and would like your organization to be considered for a 2017 Innovation Award, you will need to confirm via letter provided by NetApp that accepting a NetApp Innovation Award does not violate your organizations policies or any local laws. This signed letter is a prerequisite for consideration of a 2017 Innovation Award and must be included with the nomination.

  3. ENTRY PERIOD AND VOTING PERIOD
    Entries must be submitted on or between March 20, 2017 and May 31, 2017. All entries must be received by 11:59 PM Pacific Daylight Time (PDT) on May 31, 2017 to be eligible. Entries must be received during the Entry Period. Entries received after the Entry Period will be declared invalid.

    Voting will open to the public on August 7 , 2017 and will close on September 12, 2017. All votes must be received by 11:59 PM Pacific Daylight Time (PDT) on September 12, 2017 to be considered. All votes must be received during the Voting Period. Votes received after the Voting Period will not be counted.

  4. DETERMINATION AND NOTIFICATION OF THE WINNER
    All nominations will be reviewed by the Innovation Awards Program Office for completeness and to ensure that the nominations meet the criteria for the 2017 Innovation Awards. Innovation Award Nominees must demonstrate how they have delivered measurable (quantitative and/or qualitative) business value based on their use of NetApp products and solutions.

    The NetApp Executive Panel, consisting of ten (10) NetApp executives and four (4) 3rd party representatives serving as judges, shall select four (4) Finalists and four (4) Semi-Finalists.

    The public will cast their votes during the Voting Period. Only one vote per visitor can be submitted from a web browser within a twenty-four (24) hour period. The Finalist with the highest number of votes will be declared the Winner. The Winner will be announced at NetApp Insight in Las Vegas, NV on or between October 2 , 2017 and October 5, 2017. In the event of a tie, two (2) Winners will be announced.

  5. PRIZES
    Each of the four Finalists and four semi-finalists as determined by the executive judging panel will receive two (2) passes to Insight Las Vegas (approximately $2,000.00 USD each), suite accommodations and business-class travel (approximate retail value will vary) and car service to and from McCarran International Airport and Mandalay Bay Hotel (approximately $150.00 USD roundtrip). Finalists will also have an opportunity to participate in a “VIP event” (not to exceed $1,000.00 USD per person). The Winner(s) will be presented with a first place trophy and Finalists will be presented with smaller trophies. The Winner(s) and Finalists and Semi-Finalists will receive two (2) trophies each for their respective companies (approximately $350.00 USD each).

    Finalists’ respective executive representative must be able to attend the VIP Event on October 1, , 2017 and Insight on October 2 26, 2017 through October 5, 2017 and accept the award on behalf of the Finalists. If Finalists’ executive representatives cannot attend Insight, for any reason, or be present to accept the award, their nomination and Prize shall be forfeited.

  6. TERMS AND CONDITIONS
    The Innovation Awards are governed by these Official Rules. By participating in the Innovation Awards, Nominees fully and unconditionally agree to be bound by the terms of these Official Rules and understand that the Innovation Awards results are final in all respects. Nominees agree that all decisions regarding the Innovation Awards, including but not limited to the selection of the winners, will be made by NetApp, whose decisions shall be final and binding.

    If, in NetApp’s opinion, there is any suspected tampering or evidence of actual tampering or technological corruption, NetApp reserves the right to void any suspect entries and/or votes. Any attempt to undermine the legitimate operation of the Innovation Awards is a violation of criminal and civil laws and, should such an attempt be made, NetApp reserves the right to seek damages from any such person and to seek other remedies to the fullest extent permitted by law. NetApp is not responsible for late, lost, delayed, damaged, misdirected, incomplete, void, and/or corrupted entries and/or votes, or for any problems, bugs or malfunctions encountered when submitting entries and/or votes.

    NetApp will not replace any lost or stolen prize; the prize is offered and must be accepted “as is” without warranty of any kind. The approximate retail values are subject to change based on current market conditions at the time of prize fulfillment. Winners are not entitled to any surplus between actual retail value (ARV) of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. No substitution, assignment, transfer, or cash redemption of any prize is allowed by the Finalists/Winner. NetApp reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. The Finalists/Winner are solely responsible for all shipping fees and costs associated with the shipment and/or transmittal of the prizes and all applicable national, federal, state, provincial and local taxes. All national, federal, state, provincial and local laws apply.

    Failure to claim a prize will result in forfeiture of the prize and an alternate Finalist/Winner may be selected. Finalists/Winner may be requested to provide NetApp with proof that he/she is an authorized representative of Finalists/Winner and that all eligibility requirements are met. All personal and other information requested by and supplied to NetApp for the purpose of the Innovation Awards must be truthful, complete, accurate and in no way misleading. NetApp reserves the right, in NetApp’s sole discretion, to disqualify any Nominee should such a Nominee supply untruthful, incomplete, inaccurate or misleading personal details and/or information. If a potential Finalist/Winner is unable to participate in or accept the prize or any portion of the prize for any reason, NetApp shall have no further obligation to such potential Winner.

    Nominees agree that NetApp is not responsible for [i] lost, late, delayed, misdirected, stolen, unintelligible, or incomplete submissions; [ii] telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties; [iii] errors in transmission; or [iv] any condition caused by events beyond NetApp’s control that may affect the Innovation Awards. All entries become the property of NetApp.

    By participating in the Innovation Awards, each Nominee agrees to release and hold NetApp harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Innovation Awards or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, misappropriation of likeness, or invasion of privacy. Nominees agree that NetApp shall have no liability whatsoever for any deficiency or malfunctioning of any prize, for any damage incurred from use or participation of the prize, or from participation in the Innovation Awards.

    NetApp reserves the right to change, alter, or amend these Official Rules, modify the Innovation Awards criteria to include additional products, solutions and/or technologies, or terminate the Innovation Awards, in its sole discretion, to provide fair administration of the Innovation Awards or to comply with applicable law. No cash or other substitution is permitted, except as provided herein at NetApp’s sole discretion. Prizes are nontransferable, unless otherwise specifically approved by NetApp in writing.

    These Official Rules are governed by the laws of the State of California without regard to conflict of laws principles. By participating in the Innovation Awards, Nominees hereby agree that the exclusive jurisdiction and venue for any claims, actions, or proceedings relating to the Innovation Awards shall be the state and federal courts located in Santa Clara County, California.

  7. DATA PRIVACY
    All information, including personal data, collected in submission of entries during the Innovation Awards, will be maintained and protected by NetApp in accordance with applicable data protection laws. The personal data you provide will be used strictly for the purpose of managing the Official Rules of the Innovation Awards, and to provide you with information related to NetApp products, services and events. You may opt out of receiving information from NetApp at any time by writing to privacy@netapp.com.  NetApp will not share your personal data with any third-party partners without your explicit consent.
